On May 12, 2025, CFPB withdrew 67 guidance documents issued by the agency since it opened for business in 2011. The documents withdrawn include policy statements, interpretive rules, advisory opinions, circulars, and bulletins and cover almost every aspect of a financial institution’s operations (e.g., deposit accounts, lending, etc.)
The important thing to remember is that many of these guidance documents were interpretations of laws and regulations that are still in force. For example, while the CFPB may be taking a back seat in monitoring for unfair, deceptive, or abusive acts and practices, UDAAP risk is still present from a state enforcement perspective.
