Copenhaver now leads Deery in District 23 recount
The Indiana Recount Commission voted Monday to exclude several challenged ballots in the Republican primary for Senate District 23, reversing the previously certified three-vote lead held by State Sen. Spencer Deery, R-West Lafayette. Following the recount, challenger Paula Copenhaver leads Deery by three votes, 6,332 to 6,329. The Commission excluded eight ballots cast for Deery and two cast for Copenhaver, largely due to missing signatures or initials from county election officials on absentee or provisional ballots. Deery's attorney said he plans to appeal the Commission's decision to the Indiana Court of Appeals. The eventual Republican nominee will face Democrat David Sanders and independent candidate Joshua Brant in the November general election.
Former IURC Chair files lawsuit against administration
Former Indiana Utility Regulatory Commission Chair Andy Zay filed a lawsuit Monday seeking to regain his seat on the commission following his removal by Gov. Mike Braun last week. Zay's lawsuit, filed in Marion County Superior Court, alleges his removal was connected to his vote in June to approve a $71 million rate increase for AES Indiana customers and occurred before the Commission considers a petition for rehearing in the case. Braun has appointed former Indianapolis City-County Councilor Joshua Bain to replace Zay. Zay, a former state senator, joined the IURC as chair in January after being appointed by Braun in December. The State Personnel Department has cited several potential violations of state policy related to Zay's removal.
